01 / What OpticBroker is
OpticBroker, LLC ("OpticBroker", "we") operates opticbroker.com, a marketplace where members buy and sell sport optics: rifle scopes, red dots, binoculars, spotting scopes, birding optics, thermal and night vision optics, rangefinders, tripods, and mounts. OpticBroker is the venue and the escrow agent for each sale. We are not the buyer or seller of the items listed, and we do not take ownership of them at any point.
By creating an account or completing a transaction you agree to these terms. If you do not agree, do not use the marketplace.
02 / Accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for what happens under your account and for keeping your password to yourself. One person per account, and the information you give us has to be accurate. We can suspend or close accounts that break these terms, game the marketplace, or expose other members to risk.
03 / Fees
Our fee model is flat and public:
- ·Buyers pay no marketplace fee. The price you see, plus shipping where the seller charges it, is what you pay.
- ·Sellers pay a 5% commission on the item price when a sale completes.
- ·Payment processing costs (currently 2.9% plus 30 cents per transaction, set by our payment processor) are deducted from the seller’s proceeds.
- ·Fees may change; a change applies only to listings created after we announce it.
04 / How buying works, including escrow
When you buy an item or win an auction, your saved card is charged for the full amount. We hold those funds in escrow: the seller is not paid when you pay. The seller ships, and once you confirm the item arrived as described (or the protection window passes without a dispute), the escrow releases the seller’s net proceeds to them. This is the heart of the marketplace: the seller does not get your money until you have the glass in hand.
Payments are processed by Stripe. Your card details go directly to Stripe and never touch our servers. Sellers receive payouts through Stripe Connect and must complete Stripe’s identity verification before they can be paid.
05 / Auctions and bids
A bid is a binding offer to buy at that price, backed by the card on your account. If you win, the sale proceeds like any other purchase. Do not bid on your own listings, arrange off-platform completion of an auction, or bid without intending to pay. Sellers may set a buy-it-now price; the first buyer to take it ends the auction immediately.
06 / Selling and listing accuracy
Describe the item you actually have. Condition, function, included accessories, and defects must be stated honestly, and photos must be of the actual item. When a listing sells, we snapshot it; that snapshot is the record of what the buyer agreed to. Once an auction has bids, the terms bidders relied on (price, condition, category) lock, though you can still add photos and append clarifications.
Sellers must ship within 2 business days of sale using tracked shipping. Pack optics properly: caps on, padded, double-boxed. An item damaged by poor packing is the seller’s responsibility.
07 / Prohibited items and conduct
The marketplace is for optics and optic accessories only. Never list:
- ·Firearms, receivers, suppressors, or any item requiring a federal firearms license to transfer.
- ·Stolen, counterfeit, or misrepresented goods, including refurbished items sold as new.
- ·Items you are not legally allowed to sell or ship. Certain thermal and night vision devices are export-controlled under U.S. law (ITAR/EAR); sellers are responsible for compliance, and all sales must ship within the United States.
08 / Disputes, returns, and refunds
If an item arrives materially different from its listing snapshot, contact us before confirming delivery and do not use the item. While funds are in escrow we can refund the buyer in full. After you confirm delivery, escrow releases and the sale is final between you and the seller, though we will still investigate fraud.
Chargebacks filed instead of using the dispute process may result in account suspension while we resolve them.
09 / Our role and liability
We provide the venue, the escrow, and the tooling, and we vet what we reasonably can, but each sale is a contract between buyer and seller. To the fullest extent the law allows, OpticBroker’s liability for any claim arising from a transaction is limited to the fees we earned on that transaction. We do not warrant listings, and we are not liable for indirect or consequential damages.
We may remove listings, cancel transactions, or withhold escrow where we suspect fraud, a policy violation, or a legal requirement.
10 / Governing law and changes
These terms are governed by the laws of the United States and the state in which OpticBroker, LLC is organized. If we change these terms in a way that matters, we will post the new version here with a new date; continuing to use the marketplace after that is acceptance.
